RI 1 appealed a State Council decision fixing the forest boundary next to the buildable area of the former municipality. On 29 September 2004, the appellant notified the Tribunal della pianificazione del territorio that he was withdrawing the appeal. The court therefore held that the proceedings were exhausted, struck the appeal from the docket, and ordered that no court fees or costs be charged.
Withdrawal of an administrative appeal; where the appellant withdraws the appeal, the court notes the termination of the proceedings and strikes the case from the docket. In the absence of contrary grounds, no fees or expenses are levied (consid. 1-2).
