Résumé

RI 1 appealed against the Cantonal Government’s approval of the zoning plan of the former municipality of Fusio. Before judgment, it informed the Planning Court that its grievances had in substance been resolved by a later amendment of the zoning plan approved on 8 June 2004 and asked that the appeal be removed from the docket. The court held that the proceedings were therefore exhausted, struck the appeal from the docket, and ordered that no fees or costs be levied.

RI 1 rappr. dal Consiglio parrocchiale, 6696 Fusio,

contro

la risoluzione 18 marzo 2003, n. 1181, con cui il Consiglio di Stato ha approvato il piano regolatore del già comune di Fusio;

preso atto che, con scritto 29 agosto 2005, il RI 1 ha comunicato a questo tribunale che le censure avanzate con il summenzionato ricorso "sono in sostanza state evase con la modifica del piano regolatore, relativa ad alcuni comparti, approvata dal Consiglio di Stato con decisione no. 2397 dell'8 giugno 2004" e che il ricorso possa essere stralciato dai ruoli;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
