The Tribunal of Spatial Planning dealt with an appeal against the State Council’s approval of a municipal zoning plan revision. Before a merits decision, the appellants’ representative informed the court by letter of 10 July 2003 that the appeal was withdrawn. The President therefore struck the case from the docket and ordered that no fees or costs be collected. The decision was served on the appellants, their representative, the municipality, the territorial planning division, and the State Council.
Withdrawal of an administrative appeal pending before the planning authority; upon valid withdrawal the proceedings are struck from the roll without a merits determination. In the absence of a substantive judgment, the court may waive the levying of fees and costs (consid. implicit).
