The appeal against the State Council's approval of the Stabio zoning plan was withdrawn at the hearing. The Tribunal della pianificazione del territorio therefore found the case moot and struck it from the roll. It further held that the withdrawing appellant had to bear the municipality's party costs, setting them at CHF 500, while no court fee was charged.
Art. 31 PAmm; withdrawal of an administrative planning appeal and costs consequences; once the appellant withdraws the appeal, the proceeding becomes devoid of object and is struck from the roll. The withdrawing party is to be treated as unsuccessful for purposes of party compensation and may be ordered to reimburse the opposing municipality’s costs. Pursuant to Art. 28 PAmm, no justice fee is levied where the court so decides.

letti ed esaminati gli atti;
ritenuto e considerato, in fatto e in diritto
che il piano regolatore di Stabio, approvato dal Consiglio di Stato con risoluzione 7 maggio 2002, assegna il mapp. __________ alla zona agricola;
che il ricorrente ha chiesto l’inserimento nella zona estensiva del mapp. __________;
che, all’udienza del 24 settembre 2003, l'insorgente ha dichiarato di ritirare il ricorso;
che il municipio, d’accordo con lo stralcio del gravame, ha protestato spese e ripetibili;
che il procedimento di cui trattasi è pertanto divenuto privo di oggetto;
che il gravame, ritirato, va dunque stralciato dai ruoli;
che, inoltre, il Comune di __________, assistito da un patrocinatore, ha diritto al versamento di ripetibili da parte del ricorrente il quale, a seguito del ritiro dell'impugnativa, dev'essere considerato soccombente giusta l’art. 31 PAmm (cfr. Borghi/Corti, Compendio di procedura amministrativa ticinese, ad art. 31 n. 2; inoltre Merkli/Aeschlimann/Herzog, Kommentar zum bernischen VRPG, Berna 1997, ad art. 110 cpv. 1 n. 3 e seg.);
che il Tribunale non preleva tasse di giustizia (art. 28 PAmm);
decreta:
Il ricorso è stralciato dai ruoli.
Non si preleva una tassa di giustizia. __________ __________ è condannato a versare al Comune di __________ fr. 500.- (cinquecento) per ripetibili.
