The appellants challenged a 7 May 2002 State Council resolution concerning the determination of the forest boundary at the edge of the building zone in Paradiso. Before the Tribunal of the Planning of the Territory, the appellants' representative notified the court on 30 June 2003 that the appeal was being withdrawn. The court therefore struck the case from the roll and ordered that no fees or costs be collected.
Withdrawal of an appeal; the proceeding is struck from the roll and, absent special reasons, no court costs are levied. Once the appellant withdraws the challenge, the court no longer rules on the merits and limits itself to procedural termination and cost allocation.
