The appellant challenged the State Council’s decision approving the municipal zoning plan. At the hearing on 25 September 2002, the appellant’s representative withdrew the appeal. The Tribunal consequently struck the case from the docket and ordered that no court fees or costs be levied.

Regeste Omnilex

Withdrawal of an administrative appeal before the planning tribunal; the court strikes the matter from the docket and, absent special circumstances, may waive fees and costs. Once the appellant expressly withdraws the challenge, there is no longer a justiciable dispute requiring a merits determination (consid. 1). The court may therefore terminate the proceedings by procedural decree and regulate costs accordingly (consid. 2).
