RI 1, RI 2 and RI 3 appealed against the State Council's refusal to approve a zoning plan amendment that would have included parcel no. 20 in mixed zone R-A2. Before the planning court, the appellants later informed the court through their lawyer that they were withdrawing the appeal. The Tribunal of Territorial Planning therefore struck the case from the docket and ordered that no court fees or expenses be charged.
Appeal withdrawal before the planning court; the proceedings are terminated and the case is struck from the docket. Where the appeal is withdrawn and the court does not otherwise decide on the merits, the case is removed from the roll. In such circumstances, the court may order that neither fees nor costs be levied (consid. implicit).

la decisione 5 novembre 2002 (n. 5144) con la quale il Consiglio di Stato non ha approvato la variante di piano regolatore del PI 1, che inseriva il mapp. 20 nella zona mista R-A2;
preso atto che il 16 giugno 2004 i ricorrenti, per il tramite del loro patrocinatore, hanno comunicato di ritirare il ricorso;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
