Résumé

Seven appellants challenged the State Council's approval of certain zoning plan variants of the municipality of Coldrerio before the Territorial Planning Court. Before the court ruled, their counsel informed the court on 2 August 2005 that the appeal was withdrawn. The president therefore ordered the proceedings struck from the docket and decided that no court fees or expenses would be charged.

Withdrawal of an appeal renders the proceedings exhausted and leads to the appeal being struck from the docket; in such a case, absent special circumstances, no court fees or expenses are levied. The court does not examine the merits once the appellants have validly withdrawn the recourse (consid. implied).

considerato pertanto che il procedimento è così esaurito;

decreta:
