The Territorial Planning Court of Ticino dealt with an appeal against a State Council resolution fixing the forest boundary at the edge of a buildable zone. Before the court ruled, the appellant withdrew the appeal by letter. The court therefore found the case moot and ordered the appeal struck from the docket. It also decided that no court fees or costs would be charged.
Withdrawal of appeal; mootness; strike-off from the docket. When the appellant withdraws the appeal before judgment, the proceedings lose their object and are removed from the docket. In such a situation the court may order that no fees or costs be levied (consid. 1-2).
