C.E. appealed against a State Council resolution approving a planning amendment concerning the removal of constraints for a road connection project. Before the court decided the merits, the appellant’s representative informed the tribunal that the appeal was withdrawn. The Tribunal of the planning of the territory therefore found that the dispute had become moot, struck the appeal from the roll, and ordered that no fees or costs be collected.
Withdrawal of the appeal renders the proceedings moot; the court strikes the case from the roll and may dispense with court fees and costs when no live controversy remains.
