Résumé

The appellant filed an appeal against a State Council resolution approving an inventory of buildings outside the building zone in the municipality concerned. Before the court decided the merits, the appellant withdrew the appeal by letter of 27 May 1998. The Tribunal of Territorial Planning held that the case had become moot and struck it from the roll. It also ordered that no court fees or costs be levied.

Withdrawal of an appeal renders the proceedings devoid of object; the court shall strike the matter from the roll. In such a procedural dismissal, the court may order that no fees or costs be charged where the case is terminated without a merits decision (consid. implicit).
