The appellant challenged the State Council’s approval of a zoning-plan amendment concerning an inventory of buildings outside building zones. After filing observations, the appellant informed the court by letter of 27 September 1999 that the appeal was withdrawn. The Planning Court held that the case had become moot and ordered the appeal struck from the docket. It also decided that no fees or costs would be collected.
Withdrawal of an appeal; mootness and removal from the docket; no costs where the proceedings lose their subject matter after an express withdrawal. Once the appellant unequivocally withdraws the challenge, the court no longer has a live dispute to adjudicate and must strike the matter off the rolls (consid. implicit). In such circumstances, absent a substantive adjudication, the court may dispense with the collection of court fees and expenses.
