The municipality appealed a State Council decision approving a variant of the municipal zoning plan. Before the court ruled, the municipality withdrew its appeal by letter dated 17 April 1996. The Territorial Planning Court therefore held that the case had become moot and ordered the appeal struck from the docket. It also ordered that no fees or costs be charged.
Withdrawal of appeal; mootness and costs; where the appellant withdraws the appeal before judgment, the proceedings become devoid of object and the appeal is struck from the docket. In such a situation, the court may order that no court fees or costs be levied, particularly where no further adjudication on the merits is required.
