The appellant challenged a Cantonal Government resolution approving variants of a municipal zoning plan. At the hearing before the Tribunal of Territorial Planning, the appellant declared that the appeal was withdrawn. The court therefore found the case moot and struck the appeal from the docket. It ordered that no court fees or costs be levied.
Withdrawal of an appeal renders the proceedings moot; the court strikes the case from the roll and, absent further grounds, does not levy court fees or costs.
