The Territorial Planning Tribunal of Ticino dealt with an appeal against the State Council's approval of a municipal zoning plan. Before the merits were decided, the appellant informed the court by letter that the appeal was withdrawn. The tribunal therefore found the case moot, struck the appeal from the docket, and ordered that no fees or costs be taken.
Withdrawal of the appeal; mootness; striking-off of the cause. Where the appellant expressly withdraws the appeal, the appellate court no longer has a live controversy to decide and removes the case from the docket; in such circumstances, no court fees or costs are levied, absent special reasons to the contrary.
