In a second-instance tax appeal concerning IC/IFD 2001-2002, the appellant withdrew the appeal by written declaration dated 30 August 2004. The Tax Chamber of the Court of Appeal therefore found the matter moot and struck it from the docket. It also ordered that no court costs and no justice fee be levied.

Art. 207 cpv. 2 LT, 228 LT; art. 134 cpv. 2 e 142 cpv. 4 LIFD: withdrawal of the appeal renders the proceedings devoid of object, so the appellate tax court strikes the case from the docket. In such circumstances, and absent contrary reasons, no court costs or justice fee are levied.
