In a tax appeal concerning IC/IFD 1997/1998, the appellant withdrew the recourse at the hearing of 31 May 2000. The Camera di diritto tributario of the Tribunale d'appello held that the appeal had therefore become devoid of object and ordered it struck from the docket. It further decided that no court costs or justice fee would be levied.

Art. 207 cpv. 2 LT; art. 228 LT; art. 134 cpv. 2 and 142 cpv. 4 LIFD: if the appellant withdraws a tax appeal, the proceeding becomes moot and is to be struck from the docket; in such a case the court may waive the levying of costs and justice fees.

  • atteso che il giudice, alla luce del ricorso presentato dalla ricorrente, ha incaricato l'ispettore fiscale della Camera di diritto tributario di esperire una verifica;

  • preso atto che nel verbale di audizione del 31 maggio 2000 la ricorrente ha dichiarato di ritirare il ricorso;

  • considerato che con ciò il gravame é diventato privo di oggetto;

  • visti gli art. 207 cpv. 2 e 228 LT, come pure gli art. 134 cpv. 2 e 142 cpv. 4 LIFD;

decreta

  1. Il ricorso é stralciato dai ruoli.

  2. Non si prelevano né spese né tassa di giustizia.
