In such a case the appeal is only partially upheld; costs may be waived under the applicable provisions (consid. 1-2).

in fatto ed in diritto

  • che l'Ufficio di tassazione ha esposto ai coniugi __________ e __________ __________ un reddito aziendale di fr. 28'000.- di media annua in relazione all'attività di parrucchiera indipendente svolta dalla moglie (cfr. notifica di tassazione del 30 giugno 1998);

  • che in sede di reclamo il reddito aziendale veniva ridotto a fr. 20'000.- di media annua (cfr. decisione su reclamo del 25 gennaio 1999);

  • che con il presente tempestivo ricorso i ricorrenti chiedono un'ulteriore riduzione del reddito aziendale, sottolineando come i diversi esercizi abbiano chiuso con delle perdite e come nel 1998 per far fronte alle necessità quotidiane abbiano dovuto far capo al prestito;

  • che, conformemente all’art. 26c cpv. 2 della legge organica giudiziaria civile e penale del 24 novembre 1910, modificata il 14 maggio 1998, la Camera di diritto tributario decide nella composizione di un Giudice unico la presente causa, che non pone questioni di principio e non è di rilevante importanza;

  • che all'udienza del 16 marzo 1999 la ricorrente __________ __________ ha spiegato ampiamente i motivi che l'hanno indotta a riprendere l'attività di parrucchiera dopo un'interruzione di diversi anni per ragioni di salute e ha altresì illustrato il tipo di attività svolta;

  • che il giudice ha quindi proposto alle parti di stabilire il reddito aziendale in fr. 15'000.- di media annua, aggiungendo in pratica ai prelevamenti privati dichiarati il sussidio a fondo perso per l'acquisto di attrezzature, che è stato parzialmente ammortizzato;

  • che le parti hanno aderito seduta stante a detta proposta;

Per questi motivi,

visti per le spese gli art. 144 LIFD e 231 LT 1994

dichiara e pronuncia

  1. Il ricorso è parzialmente accolto.

§ Di conseguenza, la decisione su reclamo del 25 gennaio 1999 è riformata nel senso che il reddito aziendale è ridotto a fr. 15'000.- di media annua.

§§ Gli atti del procedimento sono pertanto retrocessi all' Ufficio di tassazione per l'emissione di nuovi conteggi.

  1. Non si prelevano né tassa di giustizia né spese.

  2. Intimazione alle parti.

  3. Per l'IC il presente giudizio è definitivo (art. 230 cpv. 3 LT 1994).

Per l'IFD è ammesso il ricorso entro 30 giorni al Tribunale federale in Losanna (art. 146 LIFD).
