The taxpayer appealed a tax guarantee request but withdrew the appeal by letter dated 14 August 1998. The Ticino Tax Chamber of the Court of Appeal held that the appeal had become without object and ordered it struck from the docket. The court also decided that no costs or justice fees would be charged.
Appeal withdrawn; case becomes moot and is struck from the docket; when the gravamen no longer has an object after withdrawal, the court removes it from the rolls and may waive costs pursuant to the applicable cantonal and federal tax procedural provisions (Art. 207 cpv. 2 LT; Art. 228 LT; Art. 134 cpv. 2 and Art. 142 cpv. 4 LIFD).
