The taxpayer, represented by Fiduciaria __________ SA, appealed a special capital-gain tax assessment issued after cessation of a business in 1992. Art. 231 LT 1994; special capital-gain assessment and valuation of business real estate: where the valuation basis is specifically and substantiatedly contested, the appeal court may order an independent expert review and substitute the assessment on that basis. If the expert valuation is accepted by the parties, the objection decision is to be reformed accordingly and the file remitted to the tax authority for a new computation of the special tax. Where the remittal is caused by the court's reassessment of the taxable value, no judicial fees or costs need be levied (consid. 2).

Letti ed esaminati gli atti;

ritenuto

  • che __________, già titolare del Bar __________ , ha cessato l'attività aziendale nel corso del 1992;

  • che il 12 marzo 1996 l' Ufficio di tassazione di __________ ha notificato alla contribuente un'imposta annua intera a fine assoggettamento o in caso di intermedia ex art. 101 LT 1976, determinando l'imponibile sia per l' IC sia per l' IFD , già dedotto il contributo AVS, in fr. 120'475,10;

  • che __________ ha presentato reclamo contro la suddetta notifica, chiedendo lo stralcio dell'utile derivante dalla privatizzazione della parte dell'immobile in cui era situato l'esercizio pubblico;

  • che l'UT con decisione del 22 aprile 1996 ha respinto il reclamo, rilevando come la valutazione dell'utile derivante dalla privatizzazione di parte dell'immobile poggi su una valutazione effettuata dal perito dell'Ufficio cantonale di stima;

  • che con il presente tempestivo ricorso contro la decisione su reclamo relativa alla notifica della tassazione speciale (profitto in capitale) imposta cantonale 1992, __________, assistita dalla Fiduciaria __________ SA, chiede lo stralcio dal profitto in capitale della parte attribuita all'immobile, contestando i parametri utilizzati dal perito dell'Ufficio cantonale di stima;

  • che questa Camera ha dato incarico al proprio perito di verificare, alla luce delle puntuali contestazioni contenute nel ricorso, la valutazione posta dall'UT alla base della propria decisione;

  • che nel suo rapporto del 25 giugno 1996 il perito propone di considerare, tutto ben considerato, quale valore venale quello che scaturisce dal valore a reddito, vale a dire fr. 3'750'000.--;

  • che pertanto il valore della parte aziendale scende da fr. 850'000.-- a fr. 821'500.--;

  • che le parti hanno dato il proprio accordo alla suddetta valutazione;

  • che pertanto gli atti del procedimento devono essere retrocessi all' Ufficio di tassazione perché emetta il nuovo conteggio dell'imposta speciale;

Per questi motivi,

visto per le spese l'art. 231 LT 1994

dichiara e pronuncia

  1. Il ricorso è parzialmente accolto.

§ Di conseguenza, la decisione su reclamo del 22 aprile 1996 è riformata a'sensi dei considerandi.

§§ Gli atti del procedimento sono pertanto retrocessi all' Ufficio di tassazione di Locarno perché emetta il nuovo conteggio.

  1. Non si prelevano né tassa di giustizia né spese.

  2. Intimazione alle parti.

  3. Il presente giudizio è definitivo (art. 230 cpv. 3 LT 1994).
