Two taxpayers appealed a tax objection decision concerning the value of their participation in a hereditary community for IC 1993-94. The tax office had already reduced the taxable value after one plot was reclassified as non-buildable, but the taxpayers argued that a second plot had also been revalued retroactively and that the participation value should be reduced further. The court held that the records did not permit an exact reconstruction of the taxable participation and that the matter required additional factual investigation by the tax office. It therefore allowed the appeal, annulled the objection decision, and remitted the case for new findings and a new appealable decision, without costs.

Art. 231 LT 1994; remittal to the tax authority is permissible where the appellate tax court cannot reliably determine the taxable facts from the file and further factual clarification is better carried out by the tax office. Although the cantonal tax appeal body generally has full powers of review and decision, a remand is justified in particular when the challenged assessment is incomplete or defective to the point that the exact tax base cannot be reconstructed. In such a case, the appellate body may annul the decision and return the file for new investigation and a fresh decision; no court costs are to be charged where the statute so provides.

Ritenuto che

  • nella tassazione IC1993-94, notificata il 12 giugno 1995, l' Ufficio di tassazione ha esposto a __________ e __________ una sostanza derivante dalla partecipazione alla comunione ereditaria fu __________ di fr. 761'877.--;

  • a seguito del reclamo del 19 giugno 1995, in cui i contribuenti facevano presente che due dei terreni di proprietà dell'indivisione erano stati dichiarati inedificabili, il valore della partecipazione veniva ridotto dall' Ufficio di tassazione, con decisione su reclamo del 29 gennaio 1996, a fr. 719'350.--;

  • con tempestivo ricorso del 6 febbraio 1996 i contribuenti chiedono l'ulteriore riduzione della partecipazione a fr. 663'507,25, ribadendo che i terreni dichiarati inedificabili sono due, il n. __________ e il n. __________ RFD di __________ e che per entrambi, e non soltanto per uno dei due, è stato ridotto retroattivamente il valore ufficiale di stima;

Considerato che

  • la LT non prevede la possibilità di una restituzione degli atti all'autorità di tassazione, ma al contrario l'autorità di ricorso dispone del più ampio potere di indagine e di decisione, sicché essa dovrebbe in linea di massima pronunciarsi nel merito di un gravame;

  • tuttavia il Tribunale federale, pronunciandosi in materia di imposta federale diretta, ha precisato che, in determinate circostanze, si giustifica una restituzione degli atti all'autorità inferiore, in particolare quando, dopo che la stessa autorità di ricorso ha stabilito di nuovo i fattori imponibili, si tratti di procedere ad un nuovo accertamento degli importi corrispondenti, per il quale l'autorità di tassazione incontra minori difficoltà (cfr. ASA 43 p. 49 e p. 387; Känzig/Behnisch, Die direkte Bundessteuer, 2. ediz., vol. III, Basilea 1992, p. 278);

  • d'altronde, una restituzione degli atti all'autorità inferiore si impone anche in quei casi in cui la decisione impugnata presenta vizi tali da inficiare la stessa validità della decisione in questione (sentenza del Tribunale amministrativo di Zurigo del 21 gennaio 1975, in RB 1976 p. 75; Zuppinger/Schärrer/Fessler/Reich, Kommentar zum Zürcher Steuergesetz, Ergänzungsband, Berna 1978, p. 198);

  • nella fattispecie, l' Ufficio di tassazione ha proceduto alla correzione del valore ufficiale di stima di uno soltanto dei terreni di __________ dichiarati inedificabili e per i quali l' Ufficio di stima ha riveduto il valore ufficiale;

  • dagli atti non è possibile ricostruire, con precisione, il valore della partecipazione, anche se il valore dovrebbe approssimativamente corrispondere a quello indicato dai ricorrente;

  • la determinazione esatta della partecipazione concerne anche altri membri dell'indivisione e si riflette inoltre sui periodi successivi;

  • si giustifica quindi la retrocessione degli atti all' Ufficio di tassazione per nuovi accertamenti;

Per questi motivi,

visto per le spese l'art. 231 LT 1994

dichiara e pronuncia

  1. Il ricorso è accolto.

§ Di conseguenza, la decisione su reclamo del 29 gennaio 1996 è annullata.

§§ Gli atti dl procedimento vengono pertanto retrocessi all' Ufficio di tassazione per nuovi accertamenti e per nuova decisione suscettibile di ricorso.

  1. Non si prelevano né tassa di giustizia né spese.

  2. Intimazione alle parti.

  3. Per l'IC il presente giudizio è definitivo (art. 230 cpv. 3 LT 1994).
