The President of the Assise Correzionali di Mendrisio asked the Ticino criminal court to convert an unpaid CHF 5,000 fine imposed on CD1 by judgment of 25 February 2004. The court found that the fine had not been paid, debt enforcement no longer appeared effective, and the convicted person had provided no justification. It therefore ordered conversion of the fine into three months' arrest and decided that no court fees or expenses would be collected.
Art. 49 CPS; Art. 347 cpv. 1 lett. a CPP: conversion of an unpaid fine into arrest. Where the convicted person fails to pay a fine, provides no justification, and execution by debt enforcement no longer appears effective, the competent authority may commute the fine into custodial arrest. The decree is an enforcement measure, not a new punishment on the merits. If the statutory conditions are met, the conversion may be ordered without levying court costs (consid. 1-2).

Vista l’istanza 13 dicembre 2004 del Presidente delle Assise Correzionali di Mendrisio, con la quale chiede la commutazione in arresto della multa di sfr. 5'000.-- inflitta con sentenza sentenza 25 febbraio 2004 a
CD1 già residente a
Considerato che il condannato non ha pagato la multa e che l’esecuzione per debiti non appare più provvedimento efficace;
ritenuto che lo stesso non ha fatto pervenire giustificazione alcuna del ncato pagamento.
Richiati gli art. 49 CPS e 347 cfr. 1 lett. a CPP
decreta 1. La multa di sfr. 5'000.-- inflitta dal Presidente delle Assise Correzionali di Mendrisio a CD1 con sentenza sentenza 25 febbraio 2004 è commutata in 3 (tre) mesi di arresto.
Non si prelevano né tasse né spese.
