The Canton Ticino criminal court decided on the prosecutor’s confiscation request concerning 4.6 grams of gross cannabis found on train CIS 156 on 2 February 2004. As the holder could not be identified and the proceedings against unknown persons had been abandoned, the court held that the narcotic fell within Art. 58 CPS and ordered its confiscation and destruction. Art. 58 CPS; confiscation and destruction of illicit narcotics irrespective of the punishability of a specific person. Where an object constitutes the product or instrument of an offence and its possession compromises public safety, morality, or public order, the court orders confiscation and destruction ex officio or upon request, even if the offender remains unknown or the criminal proceedings have been abandoned (consid. 1). Costs may be waived where the decree so provides and the applicable cantonal rules are invoked (consid. 2).

Ignoti
Considerato - che il 2 febbraio 2004, sul treno CIS 156 sulla tratta Chiasso-Lugano, le GFC hanno rinvenuto 4.6 grammi lordi di canapa (rep. SAD 5022/04);
che dagli accertamenti esperiti non è stato possibile risalire al detentore dello stupefacente;
che il Procuratore pubblico con decreto NLP 2057/04 del 15 giugno 2004 ha abbandonato il procedimento contro ignoti, motivo per cui è ora a chiedere la confisca e la distruzione dello stupefacente sequestrato;
che giusta l'art. 58 CPS il giudice, indipendentemente dalla punibilità di una determinata persona, ordina la confisca e la distruzione degli oggetti che hanno servito o erano destinati a commettere un reato o che costituiscono il profitto di un reato se tali oggetti compromettono la sicurezza delle persone, la moralità o l'ordine pubblico;
che lo stupefacente in oggetto realizza quanto previsto da detta norma e di conseguenza deve essere confiscato e distrutto.

Richiamati gli art. 58 CPS
350 CPP e 39 TG sulle spese
decreta 1. E' ordinata la confisca e la distruzione di 4.6 grammi lordi di canapa (rep. SAD 5022/04) sequestrati il 2 febbraio 2004 sul treno CIS 156 sulla tratta Chiasso-Lugano.
Non si prelevano né tasse né spese.
