The Criminal Appeals Chamber of the Ticino Court of Appeal struck the applicant’s challenge to a non-prosecution order from the docket because the court’s prior order requiring amendment of the filing within 10 days was not complied with. The chamber therefore terminated the proceeding without entering into the merits and ordered that no justice fee or costs be levied.
Art. 186 CPP; failure to comply with an order to cure procedural defects within the prescribed deadline justifies striking the proceeding from the roll. Where the court has warned that non-compliance will lead to removal from the docket, and the deadline expires unused, the appeal may be removed without examination of the merits. In such a procedural termination, costs may be waived where the dispositive order so provides.

al decreto di non luogo a procedere 23.8.2004 emanato dal sostituto procuratore pubblico Clarissa Torricelli Bernasconi;
richiamata l'ordinanza 3.9.2004 di questa Camera, che invitava l'istante ad emendare il gravame entro il termine di 10 giorni, sotto comminatoria di stralcio dal ruolo del procedimento;
rilevato che nel frattempo il termine assegnato è decorso infruttuoso;
ritenuto pertanto che il procedimento può essere stralciato dal ruolo;
visto l'art. 186 CPP,
decreta
L'istanza è stralciata dai ruoli.
Non si prelevano tassa di giustizia e spese.
