IS 1 challenged a prosecutor’s no-prosecution decree in a fraud case before the Criminal Appeals Chamber. By prior order of 14 July 2004, the court required amendment of the filing within 10 days under threat of striking out. The deadline expired without correction. The chamber therefore removed the application from the docket and charged the reduced court fee and costs, totaling CHF 70, to the applicant.
Art. 186 CPP; failure to cure a defective criminal filing within the court-fixed time limit justifies striking the proceeding from the roll. Where the party does not comply after explicit warning, the court may terminate the matter without examining the merits and allocate the reduced costs to the party that occasioned the proceedings (consid. 1).

in relazione
al decreto di non luogo a procedere 5.7.2004 emanato dal procuratore pubblico __________ nei confronti di __________ __________, __________, per titolo di truffa;
richiamata l'ordinanza 14.7.2004 di questa Camera, che invitava l'istante ad emendare il gravame entro il termine di 10 giorni, sotto comminatoria di stralcio dal ruolo del procedimento;
rilevato che nel frattempo il termine assegnato è decorso infruttuoso;
ritenuto pertanto che il procedimento può essere stralciato dal ruolo, caricando la tassa, ridotta, e le spese di giudizio alla parte che le ha occasionate;
visti gli art. 186 CPP, sulle spese l'art. 39 lett. f LTG e ogni altra norma applicabile;
decreta
L'istanza è stralciata dai ruoli.
La tassa di giustizia e le spese per complessivi fr. 70.-- (settanta) sono a carico di __________ IS 1, __________.
