The appellants appealed a State Council decision concerning increased use of public land and a parking prohibition. On 14 July 2005, their counsel notified the Administrative Court that the appeal was withdrawn, requesting compensation of party costs. The court therefore considered the proceedings exhausted, struck the appeal from the docket, ordered no court fees or expenses, and compensated the party costs.
Withdrawal of an administrative appeal; strike-off from the docket. Where the appellant withdraws the appeal, the proceedings become moot and are discontinued without a merits determination. In the absence of special circumstances, no court fees or expenses are levied, and party compensation may be offset by compensation (consid. 1-2).
