Résumé

RI 1 appealed a 15 March 2005 award granting CO 1 geology services for the V__________ pumping/turbining installation. Before the administrative court, RI 1 withdrew the appeal by letter of 2 May 2005. The court therefore struck the matter from the docket, ordered no court fees or expenses, and awarded CO 2 CHF 500 in party compensation because it had retained counsel.

Withdrawal of an administrative appeal leads to striking the case from the docket; once the appeal is withdrawn, the proceedings are exhausted and no further merits review is carried out. In procurement matters, the court may nonetheless award party compensation where the respondent was represented by counsel, while waiving court fees and expenses if the case terminates by withdrawal. Considerations on costs depend on the circumstances of the termination and the need for legal representation.

statuendo sul ricorso 22 marzo 2005 di

contro

la decisione 15 marzo 2005 dell'CO 2 (), che aggiudica alla CO 1 le prestazioni di geologia relative all'impianto di pompaggio/turbinaggio V;

preso atto che con scritto 2 maggio 2005 il ricorrente ha comunicato di ritirare il ricorso;

ritenuto che il committente si è avvalso della consulenza di un avvocato iscritto nell'apposito registro, per cui si giustifica la corresponsione di un'indennità per ripetibili;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

2.Non si prelevano né tasse, né spese.

Il ricorrente rifonderà all'CO 2 l'importo di fr. 500.- a titolo di ripetibili.
