RI 1 appealed against a public procurement decision awarding a cabbed tractor with accessories to CO 2. Before the court ruled on the merits, RI 1 informed the Tribunal cantonale amministrativo on 2 May 2005 that it was withdrawing the appeal. The court therefore considered the proceedings exhausted, struck the appeal from the docket, and decided that no fees or costs would be charged.
Withdrawal of an administrative appeal; once the appellant unequivocally withdraws the remedy, the proceedings become moot and are to be removed from the docket. In such a situation, absent special circumstances, no court fees or costs are levied (consid. 1).
