The Ticino cantonal administrative court dealt with an appeal against a 25 February 2003 planning decision. Before the court could decide the merits, the appellant’s counsel notified the court on 20 March 2003 that the appeal was withdrawn. The president therefore held that the proceedings were exhausted, struck the appeal from the register, and ordered that no court fees or costs be collected.
Withdrawal of an administrative appeal; the court strikes the case from the docket once the appellant withdraws the remedy. If the proceedings are thereby exhausted, no fees or costs are levied absent a specific basis for charging them.
