The appellant appealed a municipal decision annulling a tender concerning sun-shade works for school enlargement. Before the administrative court decided the merits, the appellant notified on 3 May 2002 that it was withdrawing the appeal. The president of the Cantonal Administrative Court therefore held that the proceedings were exhausted, struck the appeal from the docket, and ordered that no fees or costs be charged.
Appeal withdrawn before judgment; proceedings become moot and are struck from the docket. Where the appellant validly withdraws the appeal, the court no longer rules on the merits and terminates the case without assessing the challenged administrative measure. In the absence of a merits decision, costs may be left uncharged, as ordered by the court (consid. 1-2).
