Résumé

The appellant challenged a municipal procurement tender concerning the modernization of a telemeasurement and remote-control system for the municipal water supply. While the appeal was pending, the municipality cancelled the tender by resolution no. 265 of 29 April 2002 and asked that the appeal be removed from the docket. The Administrative Court held that the dispute had therefore become devoid of object and ordered the appeal struck out. It further decided that no court fees or costs would be charged.

Regest

Procurement appeal; mootness after cancellation of the contested tender. If the awarding authority annuls the procurement procedure during the appeal, the challenge loses its object and the proceedings are struck out as moot. In such circumstances, where the court does not decide the merits, it may order that no fees or costs be levied (consid. 1-2).

preso atto che il municipio di ____ ____ con risoluzione 29 aprile 2002, n. 265, ha annullato il concorso ed ha chiesto lo stralcio del ricorso poiché divenuto privo d'oggetto;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli poiché divenuto privo d'oggetto.

  2. Non si prelevano né tasse, né spese.
