The Ticino Administrative Court dealt with an appeal against a State Council decision concerning an initial connection fee for two additional apartments on a parcel in a commune. Before the court ruled on the merits, the appellant informed the court on 16 February 1999 that it was withdrawing the appeal. The court therefore struck the case from the docket, ordered no court fees or costs, and awarded the respondents CHF 400 in party compensation to be paid by the commune.
Withdrawal of an administrative appeal; strike-out of the proceedings. Where the appellant withdraws the appeal, the court declares the matter exhausted and removes it from the docket. In such a case, no court fees or procedural costs are levied, while an award of party compensation to the successful respondents may be ordered according to the circumstances (consid. 1-2).

preso atto che in data 16 febbraio 1999 il ricorrente ha comunicato di ritirare il ricorso;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Il comune di __________ verserà ai resistenti l'importo di fr. 400.-- a titolo di ripetibili.
