Résumé

The Ticino Administrative Court dealt with an appeal against a 30-day suspension of an operating authorization. During the site inspection hearing, the appellants withdrew the appeal with effect from 1 June 1999. The court held that the proceedings were therefore exhausted and ordered the case struck from the docket. It also decided that no court fees or expenses would be collected.

Withdrawal of the appeal before the administrative court; striking out of the case follows once the appellant unequivocally withdraws the remedy and no further subject-matter remains for adjudication. In such a situation, the proceedings are terminated as exhausted (consid. 1). Where the case ends by withdrawal, the court may order that no fees or costs be charged (consid. 2).

contro

la decisione 22 dicembre 1998, no 5937, del Consiglio di Stato che respinge l'impugnativa presentata dagli insorgenti avverso la risoluzione 3 luglio 1998 con cui il Dipartimento delle istituzioni (Ufficio Permessi e Passaporti

  • UPP) ha ordinato la sospensione dell’autorizzazione a gestire __________ di __________ per un periodo di 30 giorni;

preso atto che in occasione dell'udienza di sopralluogo 14 maggio 1999 __________ ha dichiarato di ritirare il suo ricorso e quello della __________ con effetto 1º giugno 1999;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
