Résumé

The Ticino Administrative Court dealt with an appeal against the President of the Council of State's refusal to grant suspensive effect to an appeal concerning an indefinite driving-license revocation for safety reasons. Before the court decided the matter, the appellant's counsel withdrew the appeal. The court held that the proceedings were therefore exhausted, struck the appeal from the docket, and ordered that no court fees or costs be levied.

Withdrawal of the appeal; striking the case from the roll and costs: where the appellant withdraws the remedy, the proceedings become moot and are terminated by removal from the docket. In such circumstances, absent special reasons, no court fees or expenses are levied (consid. 1-2).

la risoluzione 6 marzo 1998 con cui il Presidente del Consiglio di Stato si è rifiutato di concedere all'insorgente l'effetto sospensivo al ricorso inoltrato contro la decisione 12 febbraio 1998 con cui il Dipartimento delle istituzioni, Sezione della circolazione, gli ha revocato a tempo indeterminato la licenza di condurre per motivi di sicurezza;

preso atto che in data 30 giugno 1998 la patrocinatrice del ricorrente ha comunicato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
