statuendo sul ricorso 21 dicembre 1998 della
__________ patrocinati da: avv. __________
contro
la decisione 1º dicembre 1998, no. 5532, del Consiglio di Stato che respinge l'impugnativa presentata dagli insorgenti avverso la risoluzione 10 settembre 1998 con cui il municipio di __________ ha ordinato la rettifica del torrino del lift dello stabile che sorge sulla part. __________ RFD nella zona del centro storico;
rilevato che in occasione dell’udienza 29 marzo 1999, dopo discussione, le parti avevano chiesto di tenere in sospeso la causa al fine di trovare una soluzione transattiva;
preso atto che con lettera 30 giugno 1999, versata agli atti, le parti sono addivenute alla seguente transazione:
" Il municipio e la __________ si sono incontrati successivamente in data 11 maggio 1999 ed hanno trovato un accordo di transazione che sostituisce la prevista demolizione del manufatto in questione e più precisamente:
· E' inflitta una sanzione pecuniaria di fr. 20'000.--.
· La fondazione __________ si impegna a distribuire nell'anno scolastico 1999/2000 un importo di almeno fr. 30'000.-- sotto forma di borse di studio per studenti che frequentino l'Accademia di __________.
Pertanto, il ricorso inoltrato dalla __________ viene a cadere.
Con la presente la __________ formalizza il ritiro del ricorso."
considerato pertanto che il procedimento è così esaurito,
decreta:
Il ricorso è stralciato dai ruoli in seguito a ritiro.
Non si prelevano né tasse, né spese.
Non si assegnano ripetibili.
