Résumé

The appellant withdrew its appeal against the State Council decision annulling a municipal fine of CHF 1,000 for breach of the water utility regulations. The Ticino Administrative Court therefore struck the appeal from the docket, held that the proceedings were exhausted, levied no court fees or costs, and ordered the municipality to pay CHF 100 in ripetibili to the respondent.

la decisione 25 novembre 1998, no. 5420, del Consiglio di Stato che annulla la decisione 8 settembre 1998 con cui il municipio di __________ ha inflitto a __________ una multa di fr. 1'000.-- per violazione del regolamento dell'azienda acqua potabile;

preso atto che in data 20 gennaio 1999 il ricorrente ha comunicato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.

  3. Il comune di __________ rifonderà fr. 100.-- alla resistente a titolo di ripetibili.
