Résumé

The Ticino Administrative Court dealt with an appeal against a State Council decision that had confirmed a municipal domicile determination. On 17 December 1997 the appellants’ counsel informed the court that the appeal was withdrawn. The court therefore held that the proceedings were exhausted, struck the appeal from the docket, and ordered that no court fees or expenses be collected.

Administrative appeal withdrawn; proceedings terminated and case struck from the docket. Where the appellant expressly withdraws the appeal, the court need not rule on the merits and the proceeding is concluded as exhausted. In such a situation, absent contrary indications, the court may order the matter removed from the roll and refrain from charging fees or costs (consid. 1-2).

la decisione 5 agosto 1997, no. 3758, del Consiglio di Stato che respinge il ricorso 20 gennai 1997 degli insorgenti interporto contro la decisione 30 dicembre 1996 del municipio di __________, che stabiliva in quel Comune il domicilio dei ricorrenti, con effetto 1° gennaio 1997;

preso atto che in data 17 dicembre 1997 il patrocinatore dei ricorrenti ha comunicato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
