Résumé

The Ticino Administrative Court dealt with a municipality’s appeal against a departmental decision concerning compensation for the end of gas supply after the closure of an undertaking. At the hearing of 27 November 1997, the appellant declared that it withdrew the appeal. The court therefore considered the proceedings exhausted, struck the appeal from the register, and ordered that no court fees, expenses, or party compensation be levied.

Administrative appeal; withdrawal of the appeal before judgment; the proceedings are terminated and the case is struck out of the docket. In the absence of any further determination on the merits, the court need not rule on the contested administrative decision. Where the appellant withdraws the appeal, the court may simply remove the case from the roll; costs and party compensation may be waived in the dispositive order.

la decisione 2 luglio 1997, no. 75, del Dipartimento delle istituzioni che accoglie il reclamo di __________ e __________, interposto contro la decisione 10 gennaio 1996 del municipio di __________ con la quale veniva respinta la richiesta di indennizzo per la cessazione della fornitura del gas a seguito della chiusura dell'azienda;

preso atto che in occasione dell’udienza 27 novembre 1997 il ricorrente ha dichiarato di ritirare il ricorso;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.

Non si assegnano ripetibili.
