The appellant appealed against the State Council's decision confirming the refusal of retroactive building permission for the restoration of a rustic building. Before the cantonal administrative court decided the merits, the appellant's counsel withdrew the appeal. The court therefore struck the case from the docket and ordered that no fees or costs be charged.
Withdrawal of an administrative appeal; the proceedings become moot and are struck from the docket. Where the appellant withdraws the remedy before judgment, the reviewing court need not decide the merits and may simply remove the case from the register. In such a situation, and absent special circumstances, it may dispense with levying court fees and expenses.
