The Ticino Administrative Court dealt with an appeal against a State Council decision confirming a municipal building permit for two boat piers. At the site inspection hearing, the parties concluded a settlement: the applicant withdrew the construction request for one pier and gangway, the appellant withdrew the appeal, and the permit for the central pier became final. The court therefore struck the appeal from the roll and ordered that no fees, expenses, or party compensation be charged.
Building permit dispute; withdrawal of appeal after settlement. Where the parties reach a settlement during the appeal proceedings and the appellant withdraws the appeal, the court strikes the case from the roll as moot. In such a situation, the court may, in accordance with the parties’ agreement, waive court fees and expenses and order no party compensation. The decisive factor is the procedural exhaustion of the case through withdrawal, not a substantive adjudication on the merits.

la decisione 20 marzo 1996, no. 1289, del Consiglio di Stato che respinge l'impugnativa presentata dall'insorgente avverso la decisione 25 gennaio 1996, con cui il municipio di __________ ha concesso a __________, il permesso di costruire due pontili di attracco sul __________ in corrispondenza del mappale no. __________ RFD di __________;
preso atto che in occasione dell’udienza di sopralluogo di data odierna, dopo discussione, le parti sono addivenute alla seguente transazione:
"1. La parte istante dichiara di ritirare la domanda di costruzione concernente il pontile e la passerella che si dipartono dall'esistente in direzione della proprietà della ricorrente.
Con questa premessa l'insorgente dichiara di ritirare l'impugnativa.
Conclusivamente cresce in giudicato la licenza edilizia concernente il pontile progettato al centro dei due esistenti (dimensioni m 7 x 0.60).
Le ripetibili della presente sede vengono compensate.
Le parti invitano quindi il Tribunale a stralciare la causa dai ruoli senza spese e tassa di giudizio."
considerato pertanto che il procedimento è così esaurito,
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Non si assegnano ripetibili.
