The Ticino Administrative Court dealt with an appeal against a State Council decision on a building permit for a henhouse and fence. At the site inspection hearing, the parties reached a settlement fixing the fence layout and limiting the number of animals to 50. The settlement also provided that the State Council decision was reformed accordingly and that no court fees would be collected. Where the parties reach a settlement during the appeal proceedings and thereby regulate the disputed planning matter, the court notes that the case is exhausted and strikes it from the docket. If the settlement so provides, no justice fees or costs are charged; the court may accordingly order the proceedings closed without further adjudication on the merits.

la decisione 5 novembre 1996 (n. 5677) del Consiglio di Stato che accoglie il ricorso 8 agosto 1996 di __________, inoltrato contro la decisione di rilascio a __________ della licenza edilizia per la costruzione di un pollaio e la posa di una recinzione ai mappali __________, __________ e __________ RF di __________;
preso atto che in occasione dell'udienza di sopralluogo del 24 gennaio 1996, dopo discussione, su proposta del giudice delegato le parti sono addivenute alla seguente transazione:
"1. La cinta verrà costruita nel seguente modo - termine SW part. __________ - 14 m lungo il confine con la part. __________ - attraversamento in diagonale della part. __________ sino a 20 m a N dal termine SE tra la part. __________ e __________ e meglio come alla planimetria che si allega. In seguito confine part. __________ - __________ sino all'angolo NE e ritorno verso W e verso S.
1.bis. Il numero dei capi viene limitato al massimo a 50.
La decisione del Consiglio di Stato è riformata in tal senso.
Non si prelevano tasse di giustizia né di I né di II istanza.
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
