The Ticino Administrative Court dealt with an appeal against the State Council's decision declaring inadmissible an earlier challenge to a municipal building permit for a wooden wall. At the site inspection hearing, the appellant withdrew the appeal on the condition that the respondent waive party costs for both instances, and the respondent agreed. The court therefore struck the case from the roll, ordered no court fees or expenses, and awarded no party compensation.
Withdrawal of appeal; costs and party compensation. If the appellant withdraws the administrative appeal and the opposing party agrees to waive ripetibili, the court strikes the case from the roll. In such circumstances, absent contrary statutory grounds or special circumstances, no court fees are levied and no party compensation is awarded (consid. on procedural termination).

la decisione 18 settembre 1996, no. 4787, del Consiglio di Stato, che dichiara irricevibile il ricorso 19 giugno 1996 del signor __________ interposto contro la decisione 4/6 giugno 1996 del municipio di __________, con la quale è stata rilasciata al signor __________, la licenza edilizia per la formazione di una parete in legno sul mapp. no. __________ RFD __________, in zona estensiva;
preso atto che in occasione dell’udienza di sopralluogo, dopo discussione, il ricorrente ha dichiarato di ritirare il ricorso a condizione che il resistente rinunci alle ripetibili di I e II istanza;
ritenuto che il resistente si è dichiarato d'accordo alla suddetta condizione;
considerato pertanto che il procedimento è così esaurito,
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Non si assegnano ripetibili.
