The Municipal Council appealed a State Council decision that had upheld the Department of the Territory’s challenge to a municipal CHF 2,500 pecuniary sanction. Before the administrative court could decide the merits, the municipality withdrew its appeal. The court therefore removed the case from the register and ordered that no court fees or expenses be levied.

la decisione 17 luglio 1995, no. 3941, del Consiglio di Stato che accoglie l'impugnativa 27 marzo 1995 del Dipartimento del territorio, Sezione della pianificazione urbanistica, interposta contro la risoluzione 10 marzo 1995 del municipio di __________, con la quale infliggeva a __________, una sanzione pecuniaria di fr. 2'500;
preso atto che in data 11 settembre 1998 il ricorrente ha comunicato di ritirare il ricorso;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
