The Ticino Administrative Court dealt with an appeal against a 30 November 1994 decision of the Department of Institutions, Office for Permits and Passports. Before the merits were decided, the appellant's counsel informed the court on 5 January 1996 that the appeal was withdrawn. The court therefore held that the proceedings were exhausted, struck the appeal from the docket, and ordered that no fees or costs be levied.
Administrative appeal withdrawn; the court strikes the case from the docket when the appellant expressly withdraws the remedy. In such a situation, the proceedings are deemed exhausted and no court fees or expenses are levied, absent a contrary statutory or dispositive basis.
