The Ticino Administrative Court dealt with a municipality's appeal against an expropriation decision concerning a 98 m² strip of land needed to widen a road. statuendo sul ricorso 22 gennaio 2001 del
contro
la decisione 6 dicembre 2000 (no. 34/99-74) del Tribunale di espropriazione della giurisdizione sottocenerina, prolata nell'ambito del procedimento espropriativo promosso dal comune di __________ per acquisire la proprietà di uno scorporo di complessivi 98 mq del mapp. __________ di __________ in vista dell'allargamento di via __________;
preso atto che il 9 ottobre 2001 il patrocinatore del comune di __________ ha comunicato di ritirare il ricorso;
rilevato che la resistente si è avvalsa del patrocinio di un legale iscritto all'albo, per cui si giustifica la corresponsione di un'indennità per ripetibili;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Il comune di __________ rifonderà a __________ __________ l'importo di fr. 800.-- a titolo di ripetibili.
