Résumé

The Ticino Administrative Court dealt with an appeal against a decision of the president of the expropriation tribunal. Before judgment, the appellant's counsel informed the court that the appeal was withdrawn. The court therefore removed the case from the docket, held that no court fees or expenses would be collected, and ordered the appellant to pay the respondent CHF 500 in party costs because the respondent had retained counsel for its response.

Withdrawal of the appeal entails striking the case from the docket; where the proceedings are thereby exhausted, no further merits review is undertaken. In such a procedural termination, court fees may be waived, but the respondent may be awarded party costs when representation by licensed counsel was necessary for the response (consid. 1-2).

Contro

la decisione 30 marzo 1999, no. 503/72, del presidente del Tribunale di espropriazione della giurisdizione sopracenerina;

preso atto che il 27 settembre 2000 il patrocinatore del ricorrente ha comunicato di ritirare il ricorso;

ritenuto che il resistente si è avvalso di un legale iscritto all'albo per presentare l'allegato di risposta, per cui si giustifica la corresponsione di un'indennità per ripetibili;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.

Il ricorrente rifonderà al Consorzio resistente l'importo di fr. 500.- a titolo di indennità per ripetibili.
