la decisione del 14 luglio 2005 emanata da
Istituto assicurazioni sociali Ufficio assicurazione malattia, 6501 Bellinzona
in materia di assicurazione sociale contro le malattie
letti ed esaminati gli atti;
vista la risposta del 31 agosto 2005 presentata dalla parte convenuta;
rilevato che in data 24 ottobre 2005 la parte ricorrente, chiamata a presentare eventuali osservazioni in merito alla duplica della convenuta, ha affermato:
“mi riferisco al vostro scritto raccomandato del 18 ottobre nel quale mi informate che ho la facoltà di presentare eventuali osservazioni scritte entro il 25 ottobre e, preso atto che i miei diritti posso esercitarli solo con l’ausilio di un avvocato, (le mie finanze non me lo permettono) infatti gli articoli citati sulla duplica da parte dell’istituto di assicurazioni sono a me sconosciuti, vi sollecito a voler stralciare l’incarto 36.2005.103. Ritiro la causa.” (doc. XII);
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
