Two applicants challenged the validity of the notice cancelling their supplementary health insurance as of 31 December 1999. During the proceedings, the insurer asked for extensions, then stated it would not rely on the missed notice period and would cancel the supplementary covers retroactively to that date. The applicants subsequently withdrew their petitions. The cantonal insurance court therefore struck the cases from the roll and ordered no justice fee, with the expenses charged to the State.

Art. 23 LPTCA; art. 352 cpv. 1 e 2 CPC; art. 58 cpv. 3 LPA: withdrawal of the application renders the proceedings moot and leads to striking the case from the roll. In such a situation the court may discontinue the matter without charging a justice fee and may allocate costs to the State, where the procedural law so provides (consid. 1-2).

Cassa malati __________,

in materia di assicurazione contro le malattie

ritenuto che, - con petizioni 19 maggio 2000 le assicurate hanno chiesto che venga accertata la validità della disdetta delle assicurazioni complementari alla LAMal data con effetto al 31 dicembre 1999 (I);

  • le petizioni sono state intimate alla Cassa convenuta con l'assegnazione di un termine per la presentazione della risposta (II);

  • con atti 13 giugno 2000 e 5 luglio 2000 la Cassa ha chiesto di prorogare il termine assegnatole (III, V);

  • con risposta 13 settembre 2000 la Cassa malati __________ ha comunicato al TCA quanto segue:

" … la Cassa rinuncia a far valere i suoi diritti sul non rispetto del termine di risoluzione di 3 mesi previsti nelle sue condizioni generali d'assicurazione del 1997 e s'impegna ad annullare le classi complementari __________ e __________ al 31 dicembre 1999, il che dovrebbe rendere il ricorso senza appello." (VII pag. 2)

  • il 25 settembre 2000 __________ e __________ hanno dichiarato di ritirare le loro petizioni (IX);

Per questi motivi

in applicazione degli art. 23 LPTCA, 352 cpv. 1 e 2 CPC, 58 cpv. 3 LPA

dichiara e pronuncia

1.- Le cause sono stralciate dai ruoli.

2.- Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.

3.- Intimazione alle parti.
