The Ticino Cantonal Insurance Tribunal, through President Daniele Cattaneo, ruled on the taxation of counsel's fee note in a social-insurance appeal where legal aid had already been granted. The court taxed the submitted note at CHF 1,809.15 including VAT, waived the court fee, and placed the expenses on the State. It also stated that the counsel and the Department of Institutions could appeal the amount within 15 days to the Council of Moderation.
Art. 21 Legge di procedura 6.4.61; taxation of counsel fees in a legal-aid context. Where a fee note is submitted for taxation, the court fixes the honorarium by order on the basis of the filed statement; in the absence of a court fee, expenses may be borne by the State. The order may expressly reserve a short remedy against the quantified honorarium before the competent moderation authority (consid. 1-3).

rilevato che in data 23.04.02 l'avvocato __________ ha trasmesso l'allegata nota d'onorario per la tassazione;
visto in particolare l'art. 21 della Legge di procedura 6.4.61;
ordina 1. La nota è tassata in fr. 1'809.15, IVA compresa;;
Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.
Contro l'ammontare dell'onorario il patrocinatore e il Dipartimento delle Istituzioni possono ricorrere entro 15 giorni al Consiglio di moderazione.
