vista la risposta 16 febbraio 2001 della parte convenuta (cfr. Doc. _);

richiamato lo scritto 9 ottobre 2001 della __________ al TCA del seguente tenore:

" Ci riferiamo alla sua lettera del 31 maggio 2001 e all'annessa copia dello scritto dell'__________, in cui quest'ultima dichiara - a nome della signora __________

  • di convenire sull'importo delle nostre prestazioni.

Visto che nel frattempo non abbiamo ricevuto alcuna presa di posizione in merito da parte del Tribunale, provvederemo a versare, come desiderato dalla signora __________,

Ÿ i contributi di complessivamente fr. 1'901.60, più gli interessi di mora, sul conto n. __________della Banca __________ e

Ÿ la prestazione di libero passaggio di fr. 21'373.70, maggiorata degli interessi di mora, su un conto di libero passaggio presso la Banca __________." (cfr. Doc. _);

vista la lettera 17 ottobre 2001 __________ che di conseguenza dichiara di ritirare la petizione (cfr. Doc. _);

rilevato che la causa è divenuta priva di oggetto;

viste le disposizioni della Legge di procedura 6.4.1961;

decreta 1. la causa è stralciata dai ruoli:

  1. non si prelevano né tasse né spese;

  2. intimazione alle parti a sensi ed effetti di legge.
